Islamabad court summons Imran Khan in Toshakhana Reference on Tuesday!

A preliminary court in Islamabad gave on Monday a notification to PTI director Imran Khan and called him tomorrow (November 22) in the Toshakhana Reference, in which the Political race Commission of Pakistan (ECP) had precluded him.

The reference claiming that Imran had not shared subtleties of the gifts he held from the Toshaskhana and continues from their detailed deals was recorded by legislators from the decision alliance in August. Last month, the ECP had reasoned that the previous chief had for sure made "misleading proclamations and mistaken statements" concerning the gifts — a decision that provoked boundless fights by the PTI.

The guard dog's organization said Imran stood excluded under Article 63(1)(p) of the Constitution.

Recently, ECP presented a duplicate of the reference in court mentioning criminal procedures being started against the previous head. It will be heard by Extra Meetings Judge Zafar Iqbal tomorrow.
In the reference, a duplicate of which is accessible with Dawn.com, Region Political decision Chief Waqas Ahmed Malik said that Imran had outfitted the expected reports of his resources and liabilities for the years 2018, 2019, 2020 and 2021 inside the specified timeframe.

He reviewed that a reference for the matter was shipped off the ECP by the Public Gathering speaker. It expressed that Imran "purposely covered" his resources during the years 2018 and 2019 when he was the top state leader.

Malik expressed that to confirm these cases, the commission acquired Imran's articulation of resources and liabilities from the State Bank of Pakistan (SBP) and the Toshakhana record of gift things through the Bureau Secretariat.

"From the examination of the record, it uncovers that for the year 2018-2019 the present things were bought on the instalment of Rs21,564,600 from the Toshakhana based on evaluated esteem. The complete worth of gift things was Rs107,943,000."

He expressed that the gift things and their deal were not displayed in that frame of mind of resources and liabilities submitted to the ECP, nor was some other clarification about the offer of the gifts given.

Likewise, the area political race magistrate noted, Imran had neglected to add the subtleties of the money and ledger of the deal continues in the significant Structure B segments.

"The commission found that the respondent [PTI chief] had submitted misleading and inaccurate articulations and bogus announcements concerning his assertions of resources and liabilities submitted before ECP."

He included that while concluding Imran's preclusion had guided criminal procedures to be started against the previous chief under segments 137 (accommodation of explanation of resources and liabilities), 167 (degenerate practice), and 173 (making or distributing a bogus assertion or statement) of the Races Act, 2017.

Malik thusly implored that a sentence of conviction ought to be passed against Imran and upon conviction, he ought to be detained for no less than three years alongside a fine.

The reference was documented in August against Imran by the alliance government, for "not sharing subtleties" of Toshakhana gifts and continues from their supposed deal. Legislators from the Pakistan Vote-based Development — the decision union — had presented the reference to NA Speaker Raja Pervaiz Ashraf, who had accordingly sent it to Boss Political race Chief (CEC) Sikander Ruler Raja for additional activity.

Laid out in 1974, the Toshakhana is an office under the regulatory control of the Bureau Division and stores valuable gifts given to rulers, parliamentarians, civil servants, and authorities by heads of different legislatures and states and unfamiliar dignitaries.

As per Toshakhana rules, presents/presents and other such materials got by people to whom these guidelines apply will be accounted for by the Bureau Division.

In any case, the PTI, while in government, had been hesitant to reveal the subtleties of the gifts introduced to Imran since he accepted office in 2018, keeping up with that doing so would imperil worldwide ties, even as the Pakistan Information Commission (PIC) requested it to do as such.

Be that as it may, later, in a composed answer submitted to the ECP on September 8, Imran had owned up to selling something like four presents he had gotten during his residency as the top state leader.

The previous chief, in his answer, had kept up with that the offer of the gifts that he had secured from the state depository after paying Rs21.56 million brought about Rs58m. One of the gifts incorporated a graff wristwatch, a couple of sleeve fasteners, a costly pen and a ring while the other three gifts included four Rolex watches.

The reference against Imran was recorded by MNA Advocate Mohsin Nawaz Ranjha conveying marks of administrators Agha Hassan Baloch, Salahudeen Ayubi, Ali Gohar Khan, Syed Rafiullah Agha and Saad Waseem Sheik and it was hence sent to CEC Raja.

In their preclusion reference, MNAs from the decision union included narrative proof to authenticate their cases against the ex-chief and looked for his
exclusion under Areas 2 and 3 of Article 63 of the Constitution, read with Article 62(1)(f).

Article 62(1)(f) says: "An individual will not be able to be chosen or picked as an individual from Majlis-e-Shoora (Parliament) except if [… ] he is insightful, honourable and non-degenerate, legit and Ameen, there being no statement running against the norm by a courtroom."

Article 63(2) says: "If any inquiry emerges whether an individual from Majlis-e-Shoora (Parliament) has become precluded from being a part, the Speaker or, by and large, the Director will, except if he concludes that no such inquiry has emerged, allude the inquiry to the Political race Commission in thirty days and would it be a good idea for him he neglects to do as such inside the previously mentioned period it will be considered to have been alluded to the Political race Commission."

While, Article 63(3) peruses: "The Political race Commission will choose the inquiry in something like ninety days from its receipt or considered to have been gotten and assuming that it is of the assessment that the part has become excluded, he will quit being a part and his seat will become empty."

The Toshakhana case

Last year, the PIC had acknowledged an application by Islamabad-based columnist Rana Abrar Khalid and guided the Bureau Division to "give the mentioned data about the presents got by the [then] head of the state Imran from the unfamiliar head of states, head of legislatures and other unfamiliar dignitaries … depiction/detail of each gift, data about the gifts held by the PM and the Principles under which presents in this way gotten are held by him".

The Bureau Division was told to share the necessary data within 10 working days and transfer it to the authority site also.

Accordingly, the Bureau Division tested the PIC request in the IHC, guaranteeing that it was "unlawful, without legitimate power". The then-government took the position that the disclosure of any data related to Toshakhana endangers worldwide ties.

In April this year, the IHC coordinated Delegate Head legal officer Arshad Kayani to guarantee the execution of the PIC request to promote subtleties of the gifts introduced to the previous head of the state Imran by heads of state since he expected office in August 2018.
